General Provisions of the Civil Code
Article 30 [Declaration of Disappearance]
§1. When the life or death of an absentee has been unknown for seven years, the family court may, upon the petition of an interested party, make a declaration of disappearance.
§2. The same shall apply where the life or death of a person who has gone to a battlefield, who was on board a ship that sank, or who has otherwise encountered a peril likely to cause death, has been unknown for one year after the end of the war, after the sinking of the ship, or after the peril has otherwise ceased, respectively.
Article 31 [Effect of Declaration of Disappearance]
§1. A person who has received a declaration of disappearance pursuant to paragraph 1 of the preceding Article shall be deemed to have died at the time when the period set forth in that paragraph expires, and a person who has received a declaration of disappearance pursuant to paragraph 2 of the same Article shall be deemed to have died at the time when the peril ceases.
